An Italian court is tackling Jesus -- and whether the Roman Catholic Church may be breaking the law by teaching that he existed 2,000 years ago.

The case pits against each other two men in their 70s, who are from the same central Italian town and even went to the same seminary school in their teenage years.

The defendant, Enrico Righi, went on to become a priest writing for the parish newspaper. The plaintiff, Luigi Cascioli, became a vocal atheist who, after years of legal wrangling, is set to get his day in court later this month.

"I started this lawsuit because I wanted to deal the final blow against the Church, the bearer of obscurantism and regression," Cascioli told Reuters.

Cascioli says Righi, and by extension the whole Church, broke two Italian laws. The first is "Abuso di Credulita Popolare" (Abuse of Popular Belief) meant to protect people against being swindled or conned. The second crime, he says, is "Sostituzione di Persona", or impersonation.

"The Church constructed Christ upon the personality of John of Gamala," Cascioli claimed, referring to the 1st century Jew who fought against the Roman army.

A court in Viterbo will hear from Righi, who has yet to be indicted, at a January 27 preliminary hearing meant to determine whether the case has enough merit to go forward.

"In my book, The Fable of Christ, I present proof Jesus did not exist as a historic figure. He must now refute this by showing proof of Christ's existence," Cascioli said.

Speaking to Reuters, Righi, 76, sounded frustrated by the case and baffled as to why Cascioli -- who, like him, came from the town of Bagnoregio -- singled him out in his crusade against the Church.

"We're both from Bagnoregio, both of us. We were in seminary together. Then he took a different path and we didn't see each other anymore," Righi said.

"Since I'm a priest, and I write in the parish newspaper, he is now suing me because I 'trick' the people."

Righi claims there is plenty of evidence to support the existence of Jesus, including historical texts.

He also claims that justice is on his side. The judge presiding over the hearing has tried, repeatedly, to dismiss the case -- prompting appeals from Cascioli.

"Cascioli says he didn't exist. And I said that he did," he said. "The judge will to decide if Christ exists or not."

Even Cascioli admits that the odds are against him, especially in Roman Catholic Italy.

"It would take a miracle to win," he joked.

did jesus excist? i don't know, i also don't care wether he was real, or that he was just the main character of a 2,000 year old bestseller...?

the guy is dead anyway, almost 2,000 years.....and all of us know that god or such does not excist, some just don't admit it

well im catholic and believe in god. This guy will never win. He needs to face the truth. By today's standards one guy can not just change the religious world.

Yeah, even if they find a way to actually prove Jesus didn't exist, which they won't, people still wouldn't accept it, maybe over the space of a few hundred years they would, but it wouldn't make much of a difference now. It would just cause a little bit of shock, but I don't think people would take that much notice. Religious people would probably see as a "test" of their faith [lol]

How can you ever prove that jesus existed? [lol] Only like 20 death people clamed to saw him. It easily could be just one fool with 19 other friends who wanted to start something to believe in. Oh well, let them fight out. But nobody ever will know if he existed or not...

I think this guy is an idiot for challenging the church. I myself am an agnostic, but I see religion as a very personal thing, and not something people should be imposing on their peers or strangers. I'm not going to throw my full opinion on the matter out there just yet, but I may later if I feel you guys can handle it.

I've always been an atheist, but it will be very interesting to see how this turns out. My guess would be that the church will win though, judging by the way most people probably feel on the subject.

I dont think its funny to go and make fun of other religions. Were not Hitlers here. Although im catholic i still enjoy going to Bar-Mitzvah's(sp?) and i think its quite interesting. I dont think that comment was neccisary IntaminFan

Im christian but believe some stuff from loads of different religions. Apart from the mormon religion. I dont like the idea that christ migrated to america. But no offence to anyone who is mormon.

I am a major Catholic and i think this guy has no right to challenge Christ's exsitence. if he did not exsist, then all of the Christians would be Jews right now. I cant beleive that he even got a court date. most of Italy is Catholic. theat's why they call us Roman Catholics.

Hyyyper I have a question for you...how can you be so ignorant towards other peoples religions and opinions? It is self-centered and immature of you to make fun of other peoples religions, and you have no right to tell TCON or anyone at this site not to post about a topic, even though he is at a way higher level of wisdom, and maturity. I personally am a christian, and I believe that jesus was indeed real. Most of you im sure are saying "How could he make such an idiotic assumption like that is based on a book?", well its called "faith", and im sure most christians like myself have it, im am far away from being one of those "obsessed christian activits (SC?)".

And IntaminFan, how can you be so love intolerant to other peoples religions? I just dont understand how you can comfortably say "Christians suck anyway", I thought you were supposed to be one of the few people on this site, who actually arent ignorant to other peoples opinons, or beliefs...

This is why I tend to keep my beleifs to myself. Immature pricks like Intaminfan are always goign to go out of their way to say something disrespectful. I've only see one religious topic not go to the dumps. I hosted it on coasters2k.com and everybody (except for the ignored Intaminfan) were very mature about it. We held some very good discussion for about 10 pages worth of forums. We also learned many things about our peers and about different faiths. If you were part of that discussion you know what I am talking about, if not, it was a great experience. And the only reason I decided to start that topic in the first place was because C2K has a much more structured environment and the members that were there at the time were all mature adults or young adults. So I had plenty of trust in them. This site is a different story. Much more laid-back, younger, more immature crowd, it's not going to be the most intelectual of conversations. If that statement offends you, then you are one of these people. Show some more maturity and we'll have good conversation, until then, enjoy your mindless arguments.

Most interesting, Iron Man, is that just over a year ago Tony (aka IntaminFan397) was a devoted Christian who loved Jesus and could not help but engage in conversations about Him with me, praising God for all He had done in his life ... how fast he seems to have forgotten.
